1. About these Terms

These Terms of Use ("Terms") govern your access to and use of the H.O.M.E.® platform (home.fergusonlawja.com), operated by Ferguson Law ("we", "us"). By using this platform you agree to these Terms. If you do not agree, please do not use the platform.

2. What H.O.M.E.® is — and is not

H.O.M.E.® is an information and referral platform. It helps Jamaican property buyers assess their readiness, find vetted professionals, and book consultations with Ferguson Law attorneys.

• Information on this platform is general guidance only — it is not legal advice.
• A consultation booking is a request for a meeting, not the commencement of a lawyer-client relationship.
• A lawyer-client relationship with Ferguson Law is established only by a signed engagement letter.
• We do not guarantee the availability, quality, or conduct of third-party professionals listed in the directory.

3. Eligibility

You must be at least 18 years old to use this platform. By using H.O.M.E.® you confirm that you are of legal age and that the information you submit is accurate and truthful.

4. Buyer / visitor conduct

As a visitor or buyer you agree to:

• Provide accurate personal information when submitting forms or booking consultations
• Use the AI chat assistant only for genuine property-related enquiries
• Not attempt to overload, hack, scrape, or disrupt the platform or its services
• Not submit false, misleading, or fraudulent booking requests
• Not use the platform to harass, impersonate, or misrepresent any person

5. Professional directory listings

Professionals (realtors, valuators, surveyors, bankers, developers) who list on H.O.M.E.® agree to the following additional terms:

• Accuracy — all information on your profile (qualifications, registration numbers, contact details, services, rates) must be accurate and kept up to date.
• Verification — we may request proof of professional registration (e.g. REIB number for realtors, NLA survey licence). Listings with unverified credentials may be suspended.
• Conduct — professionals are responsible for all communications and services provided to clients who contact them through the platform.
• No fee guarantee — listing in the directory is currently free. We reserve the right to introduce listing fees with 30 days' notice.
• Removal — we may remove any listing at our discretion, including for inaccurate information, client complaints, or regulatory action against the professional.
• Independence — listed professionals are independent service providers and not employees or agents of Ferguson Law.

By creating or maintaining a professional listing you confirm that you hold all licences and registrations required by Jamaican law to offer the services described.

6. Bookings and payments

Consultation bookings with Ferguson Law are subject to availability and confirmation by our team.

• A booking is confirmed only when you receive a written confirmation email.
• Where a consultation fee applies, payment must be completed before the booking is finalised.
• Cancellations made more than 24 hours before the scheduled time will receive a full refund.
• Cancellations within 24 hours may forfeit the consultation fee at Ferguson Law's discretion.
• We reserve the right to reschedule or cancel bookings and will notify you as soon as practicable.

7. AI chat assistant

The H.O.M.E.® AI assistant is powered by Anthropic's Claude model. It is designed to answer general questions about the Jamaican property buying process.

• Responses are generated by an AI model and may contain errors or outdated information.
• Nothing the AI assistant says constitutes legal advice.
• Do not share sensitive personal data (national ID, bank account details) in the chat.
• Conversations may be reviewed by Ferguson Law staff to improve service quality.

8. Intellectual property

All content on the H.O.M.E.® platform — including the H.O.M.E.® brand, text, graphics, assessments, and guides — is owned by or licensed to Ferguson Law. You may not reproduce, distribute, or create derivative works without written permission.

9. Limitation of liability

To the fullest extent permitted by Jamaican law:

• We provide the platform on an 'as is' basis without warranties of any kind.
• We are not liable for the acts or omissions of any professional listed in the directory.
• We are not liable for any loss arising from reliance on information provided by the AI assistant.
• Our total liability for any claim related to the platform shall not exceed the amount you paid for the specific service giving rise to the claim.

10. Governing law & jurisdiction

These Terms are governed by the laws of Jamaica. Any dispute arising from these Terms shall be subject to the jurisdiction of the courts of Jamaica. If you access this platform from outside Jamaica, nothing in these Terms overrides statutory rights you hold under the mandatory laws of your own country. In particular:

• EU & UK consumers — you retain all statutory rights under EU and UK consumer protection law and may seek redress from your local courts.
• California residents (CCPA/CPRA) — we do not sell your personal information; your privacy rights are unaffected by these Terms.
• All international users — where H.O.M.E.® facilitates services governed by Jamaican law (e.g., a Jamaican property transaction), Jamaican law applies to that underlying matter regardless of your residence.

11. International use

The platform is operated from Jamaica. If you access it from the United States, South Africa, the UAE, India, Qatar, Singapore, the European Union, or any other country, you do so at your own initiative. We make no representation that the platform is appropriate or available in all jurisdictions, and we do not discriminate against any user based on their country of residence.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the platform after any change constitutes acceptance of the revised Terms. Material changes will be communicated by email to registered users.
